5 X-Men split the power of the Phoenix Force and with the other X-Men started to make the world an utopia, and the mutants are now heroes after years of being hated and feared. But the Avengers still opposed that much unchecked power and are now fugitives.

Magik (1 of the Phoenix 5) is in a desert in China with Iceman and Rogue. Bobby Drake is creating a network of ice across it which will melt slowly to irrigate it without the usual flash floods. All the X-Men have their own talents but Rogue is particularly useful because she can replicate another's power when it's needed in more than 1 place at a time. She now borrows some from Iceman and then Magik opens a portal to take her to ...

... New Orleans where she freezes the Mississippi River so that repairs can be made to a flood barrier before a storm hits. A worker(?)/soldier(?) recognises her Mississippi accent and gives her a thankyou gift of some cooked catfish which she eats as a picnic. But he interrupts her meal to ask if she can deal with a distress call from a navy helicopter that made a forced landing in marshlands in the Jean Lafitte (Barataria?) Nature Preserve. Anna Marie's glad to be yet another part of the X-utopia.

She uses an ice-slide to get there but is met instead by Avenger Ms. Marvel (Carol Danvers) who tells her there is no crashed 'copter. She immediately suspects an ambush and lashes out with ice-fists. She reasons that Carol was just the person they'd send to contact her because of their past connection when she accidentally stole all of her powers and memory which messed them both up for years. But she's not going to let that stop her from taking down this enemy of the new utopia.

But now she only has ice-powers while MsM has all her own powers back, so she removes a glove and touches her bare hand to Danvers' face to absorb *her* powers again. Carol reacts angrily to Rogue trying to steal her powers *again* after she knows what it did to her last time. Anna Marie claims Carol started it by ambushing her. Carol says she only wanted to talk, at the same time as power-punching her in the jaw. Rogue asks why she didn't just call but Ms Marvel says she couldn't risk the Phoenix 5 listening in. Rogue fights back with some of the power she's absorbed from her as Carol tries to persuade her that the P5 are dangerous, that the power will go to their heads and corrupt them. But Anna only sees the good that they're doing for the world. Carol warns her that a time will come when the P5 start forcing people to do what they *should*, possibly by mental control, or imprisoning those who don't conform.

Rogue is temporarily defeated but grabs a live power line and uses the energy to sucker punch her foe. Then she flies into the air with MsM and drops her in the river before turning it to ice around her. She claims that the Phoenix 5 are solving problems that the Avengers never could. But if they *do* start losing their humanity then the other X-Men will stop them as they've always stopped menaces. She hopes Carol will give up but MsM gradually blasts her way through the ice. She breaks free but Rogue encases her in more ice and exhausted MsM finally gives up.

She melts the ice round her foe's head so she can breathe and contacts Magik to come take away the new prisoner. Carol takes a last opportunity to get through to her old frenemy. She begs her to keep looking at the 5 with an open mind. Magik ports in and Carol reminds Anna how Illyana Rasputin has a demonic aspect and she'll probably be the 1st to turn to the dark side. Magik shuts her up with a magic gag. Rogue thinks the X-Brig won't be enough to hold her but Magik says she's built a better prison for Avengers. Rogue opines that putting all the Avengers in the same place is asking for trouble but Illyana tells her that she's brought a part of Limbo to Earth, and Limbo is extremely difficult to escape from. She ports them all to the Verkhoyansk Mountains in Siberia where we see a new volcano. She drops MsM into it where she's greeted by demons.

X-Men: Legacy (2008 series) #269 Review by (April 18, 2026)
This issue is part of the Avengers Vs X-Men event and occurs between AVX#8 and #9.

Rogue took Ms Marvel's powers and memories when she was part of Mystique's Brotherhood Of Evil Mutants. This was only actually shown in 1992's Marvel Super-Heroes #11 but the result was seen in 1981's Avengers Annual #10.
Carol Danvers' memories were restored but as though they had happened to someone else, and her powers remained gone. She 'joined' the X-Men and eventually gained new powers as Binary (Uncanny X-Men #164) and joined the Starjammers in space before (re)joining the Avengers as Warbird.
Meanwhile Rogue continued to use Ms Marvel's powers but was also plagued by Carol's memories. She came to the X-Men for help (UXM#171) and was gradually accepted by them. She lost MsM's powers and memories in UXM#269 after passing through the Siege Perilous.
They have since come to a mutual understanding.
