Former Captain America Steve Rogers is now an old man being sued for wrongful death in a case from 1940. His attorney, Jennifer “She-Hulk” Walters has just discovered that counsel for the plaintiffs is Matt Murdock. The trial begins….

A policeman recounts the dying declaration of Harold Fogler: how he was involved with criminals in 1940 Los Angeles and his brother Sam came out to try to persuade him to return home. Sam was accompanied by his pal Steve Rogers, then a weak little man. Sam and Steve were captured by the gang and threatened with death; Steve started trying to talk his way out. The gang leader threatened to kill Sam if Steve didn’t shut up, but Steve kept talking and Sam was slain. The police record of the incident mentions Steve saying “This is all my fault” A military historian shows that Steve Rogers volunteered for the Super-Soldier experiment one week later. Jen is unable to find a flaw in any of this testimony. Later at the law office of Matt Rocks (a duplicate of Jamie Madrox), Jen suggests to Steve that she try to get Matt Murdock thrown off the case as he is a longtime friend ad associate of Steve’s but Steve doesn’t want to win on a technicality. Jen contacts Patsy Walker—on a mission as Hellcat for the case—but she has nothing to report yet.

That night, Jen is awakened by Daredevil knocking on her window. He invites her for a late-night run and dashes off. He leads her on a wild chase over the rooftops and when she finally nabs him they talk about the case. DD reveals that he took the case because Steve asked him to, insisting he do his best to win. They part, both puzzled as to Steve’s motive….

The next day in court, Matt puts Steve Rogers on the witness stand—and he immediately states that everything Harold Fogler said was true….
